| OCTOPUSSY v RACE COMMITTEE (Race 2) |
| Facts Found Before the hearing began, Jury chairman explained that where a sailor is seeking redress claiming he was incorrectly scored OCS, if it is a question of judgment the jury will accept the race committee's judgment unless the sailor can bring clear and convincing evidence that there has been an error. On the other hand, if it is a question of identification, the jury will give equal weight to all evidence. OCTOPUSSY (THA99) was scored as OCS in Race 2 and sought redress claiming that she had dipped behind the line before starting. The Race Officer Tony Denham identified OCTOPUSSY and another boat SWITCHBLADE as OCS and had also broadcast over the radio. SWITCHBLADE returned to restart but OCTOPUSSY did not. The Individual Recall flag was kept flying for the required time. |
