KINON v TAG ()
Facts Found

KINNON claimed that she was on starboard tack on the lay line for Mark 1 when TAG came on port, and tacked to round Mark 1 in her water. KINNON had to alter course to avoid contact with TAG and called TAG to carry out a '720' penalty turn. After 20 boat lengths from the incident, KINNON displayed a protest flag on her bimini pole.
TAG claimed she was clear of KINNON when she rounded the mark and thought KINNON was protesting her for hitting the mark. As they met on the course, KINNON continued to ask TAG to carry out a '720' penalty turn which TAG carried out before finishing.

Conclusion

The Jury found that as KINNON did not display a Protest flag at the first reasonable opportunity (RRS 61.1a) her protest was therefore invalid.
Decision

The protest is refused.
