| JURY v WAGENBORG 1 (Race 6) |
| Facts Found The Jury learned from written protest number 9, that there was an incident involving WAGENBORG I that may have resulted in serious damage to WAGENBORG I and/or the Race Committee boat SERAPH. The Jury therefore initiated a protest hearing under RRS 60.3(a) (1) & (2) WAGENBORG I claimed that at the start of Race 6 when she was about to approach the start line to start, SUDSAKORN TOO tacked in front of her forcing her to take avoiding action by luffing and in so doing collided with the Race Committee boat SERAPH. The bowsprit of SERAPH damaged her starboard railings. SUDSARKON TOO claimed she approached the start line for a good distance on starboard tack and was never near WAGENBORG I at the start nor did she tack from port to starboard as WAGENBORG I approach the start line. WAGENBORG I had a collision with the RACE COMMITTEE boat SERAPH and continued to sail without doing a penalty turn to exonerate herself. She claimed that she was not at fault in the incident and was forced to break a rule by another boat SUDAKORN TOO |

| Conclusion The Jury was satisfied that SUDSARKON TOO was not to leeward of WAGENBORG I as they approached the starting line. WAGENBORG I broke RRS31 and RRS14. |
| Decision Using its discretion under SI 14.2 the Jury awards an alternative penalty as follows: WAGENBORG I shall add to her finishing position 3 places (20% of her fleet total of 17 boats = 3.4) but shall score no worse than last place. |
