MOYA HIN v PANIC (Race 1)
Facts Found

1. On the first leg to the top mark, MOYA HIN close-hauled on starboard tack approached PANIC close-hauled on port tack.
2. MOYA HIN luffed to avoid contact, hailed 'protesting' and after remaining head-to-wind for a period, fell off on port tack, and displayed a protest flag.
3. When PANIC was approximately one length from MOYA HIN, she luffed and tacked on to starboard tack.
4. PANIC considered taking a penalty but did not see the protest flag or hear the hail.

Conclusion

MOYA HIN had to alter course by luffing to avoid hitting PANIC's stern quarter.
Decision

Protest is upheld. Panic is disqualified.
