| Facts Found 1. On the first leg to the top mark, MOYA HIN close-hauled on starboard tack approached PANIC close-hauled on port tack. 2. MOYA HIN luffed to avoid contact, hailed 'protesting' and after remaining head-to-wind for a period, fell off on port tack, and displayed a protest flag. 3. When PANIC was approximately one length from MOYA HIN, she luffed and tacked on to starboard tack. 4. PANIC considered taking a penalty but did not see the protest flag or hear the hail. |
