Australian Maid (Request for Redress) (Race 1)
Abstract AUSTRALIAN MAID requested redress, claiming that she lost 4 minutes by having to avoid fishing trawlers pair-trawling near the last mark. The Jury decided that neither the Race Committee nor the Organising Authority has authority to instruct trawlers to move and therefore made no error or omission (an essential requirement to get redress in these circumstances). The request was denied. The Race Committee reported it was doing its best to set courses in areas free from fishing boats and would continue to do so.
Facts Found 1. Australian Maid was rounding the last mark. 2. Australian Maid had to avoid a fishing trawler. 3. Australian Maid lost some time during this manoeuvre 4. The Race Committee has no control over fishing trawlers
