NOTICE OF RACE
FOR KEELBOATS AND MULTIHULLS

The Regatta organisers wish to mention to all participants that the underlying aim of the event is to provide competitive and enjoyable racing for all crews, irrespective of the design or vintage of their boats.
ORGANISING AUTHORITY
With the Royal Patronage of His Majesty the King, the Regatta is organised by the Phuket King's Cup Regatta Organising Committee under the auspices of the Royal Varuna Yacht Club, in conjunction with the Yacht Racing Association of Thailand, the Royal Thai Navy and the Province of Phuket.

1. RULES
1.1 The Regatta will be governed by the rules as defined in The Racing Rules of Sailing 2009-2012 and by
The IRC 2009 Handicap Rules
The OMR rule for Multihulls
The Thai cap rating rules and the rules applicable to the rating system for the Classic Class
The RYA/RORC Sports Boats Rule (SBR)
The Platu 25 International Class Rules, amended by the National Class Association of Thailand.
The Firefly 850 Sport One Design Rules
This Notice of Race and the Sailing Instructions
References herein to a Rule or Appendix are to the RRS or its Appendices unless otherwise stated
1.2 In the case of conflict the Sailing Instructions will prevail. (This changes Rule 63.7)
1.3 For the purposes of IRC Rules 26.1.5(d) and (e), this is a regatta run on consecutive days.
1.4 No National prescriptions shall apply.
1.5 If there is a conflict between languages the English text shall prevail.
2. ADVERTISING
Advertising on a boat or by its crew is permitted in accordance with the ISAF Advertising Code. (formerly Category C) - Boats with advertising material incorporated should include details with their Entry Form.
Boats may be required to display advertising chosen and supplied by the organizing committee in the following positions throughout the regatta:
(a) the first 20% (or where the Hull Length is less than 8 metres the greater of the first 1.2m or 25%) of the forward part of each side of the hull of each participating boat for Bow Numbers and event logo; and
(b) The foremost 20% of the mainsail boom; and
(c) If the boat has a backstay a sponsor’s burgee or flag measuring a maximum of 500mm by 750 mm (“Sponsors Flag”) to be attached to the backstay.
The Race Committee reserves the right to forbid items of advertising which may conflict with the regattas sponsors, or in any way offend Thai laws or customs by their nature.
3. ELIGIBILITY
3.1 The Regatta will have the following classes:
The Race Committee (RC) may split classes into divisions.
A minimum of 6 boats are required to constitute a class or division. If less than the required minimum entrants are received the RC may join two classes. The RC reserves the right to adjust the eligibility criteria and / or reallocation of boats in the interests of fair competition. The determination of eligibility criteria and the allocation of boats to particular classes or divisions shall not be grounds for protest or redress.
Racing
Monohull keelboats with:
Hull factor not less than 9.8
IRC DLR of 145 or lower
IRC Series Date: 1995 and later
LOA of not less than 11.15
Entrants shall have a current valid Endorsed IRC 2009 Certificate
Premier
Keelboats with a maximum hull factor of 10, TCC of 1.055 or greater, and overall length 15 meters or greater.
Sportsboat
Boats shall have a valid RYA/RORC Sports Boat Rule certificate or be an SBR one-design recognised by the RYA/RORC.
IRC
Monohull keelboats of less than 24.0m LOA with a current valid IRC 2009 certificate.
As specified above, the Race Committee may split this class into divisions based on TCC and design.
Modern Classic
Monohull keelboats of less than 24.0m LOA,
IRC Series Date 1980 or earlier with a current valid IRC 2009 certificate.
Bareboat Charter
Racing under the IRC Handicap system. Each boat must be confirmed to be part of a bona fide bareboat charter fleet and their design based on standard production models with shoal keel configuration designed for charter/cruising. Boats will be sailed in charter trim, with standard mainsail, jib and one cruising chute/spinnaker with or without pole.
Boats that are chartered with full sail inventories, not carrying a full charter inventory or carrying crew who are employed or supplied by the charter company are not eligible.
Boats must carry all the equipment normally carried on a bareboat charter in its normal position except for the dinghy and its motor, oars and fuel tank. Biminis and sail covers may be removed and stowed below, but must remain on board. Any boats found to be stripped or lightened shall be subject to a penalty. Boats must comply with all safety requirements including, no part of an anchor shall overhang the bow while racing.
For charter boats which are of custom design, boats with racing configuration and/or deep keel configuration, the Committee will consider written applications for inclusion of such boats in the Bareboat Class. Applications giving details of the boat and the reasons for consideration, should be received no later than 7th November 2009.
Based on entry numbers, the Race Committee may split this class into divisions based on TCC and/or design.
Multihull
Multihull (catamaran and trimaran) boats of a size and condition acceptable to the Race Committee. Entrants should have a current valid OMR certificate. If a boat does not possess a current valid OMR certificate, an OMR rating will be calculated by the Race Committee based on the principles of the current OMR rule.
As specified above, the Race Committee may split the Multihull Class into the following divisions:
Racing Multihull (Multihulls with a current valid OMR certificate)
Cruising Multihull
Firefly 850 Sports
Racing under the one-design rules as stipulated by the Firefly 850 Sports Class Rules.
Beach Catamarans
Beach launched Catamarans of a size and condition acceptable to the Race Committee.
Classic
Vessels built or converted to sail and launched prior to 1950, or launched more recently but retaining the original grace and style of the old classics. All boats, traditional boats and ships should be of the “one off” type, with a hand-crafted hull. All entries should have a full keel with a keel hung rudder; however, short keels with a separate rudder may be accepted, at the discretion of the Race Committee, if the boat is of a traditional design.
Cruising Class
Boats, participating with the owner onboard, who are joining the regatta for the first time and are acceptable to the Race Committee. This class is designed for shorthanded sailors and for cruisers that do not normally race and therefore do not have a valid handicap certificate. Subject to owners supplying required measurements, 2009 IRC Certificates will be provided for this class as part of the entry fee.
One Design Racing
One-design classes of more than 6 boats, may apply to the Race Committee for their own class status. Applications should be made to the Race Committee by the Class Association and must be submitted no later than 7th November 2009.
3.2 All participating boats shall comply with the 2009 ISAF Offshore Special Regulations, Safety and Equipment requirements of a Category 4 Regatta with the exception of Sport Boats and Beach Catamaran Classes, which shall comply with the 2009 ISAF Category 5 Special Regulations. Boats shall comply with their Class Safety regulations, sail limitations and other regulations where they differ from ISAF Category 5.
Any boats that do not comply fully with the requirements may apply to the Race Committee for dispensation. The Committee will consider written applications for inclusion of such boats giving details of the boat and the reasons for consideration, if received no later than 7 November 2009.
3.3 All boats may be subjected to inspection at any point during the regatta, and their entry may be refused or withdrawn in the interests of safety.
3.4 A boat which meets all the requirements for Racing Class shall race in Racing Class.
The Race Committee recognizes that there may be boats that by virtue of design may qualify under these criteria in a racing class, but consider themselves more suitably placed elsewhere either by accommodations, rig, sails or other reasons.
The Committee will consider written applications for inclusion of such boats in another class giving details of the boat and the reasons for consideration, if received no later than 7 November 2009. A valid IRC certificate, sail plan, accommodation layout including details of installed equipment, keel details and crew list MUST accompany the application.
Applications based on crew criteria alone will not be entertained. The race committee’s decision shall be final and not be subject to protest.
3.5 A boat which meets all the requirements for the SBR Sportsboat Class shall race in the SBR Sportsboat Class. For Thailand Platu 25’s, the allocated weight given to an unweighted boat will be 1136kg and will not be subject to protest or request for redress (This changes Rules 60.1(b) and 62.1).
3.6 The requirement to be self-righting will not apply to the Multihull, Firefly 850 Sport and Beach Catamaran classes.
3.7 Classes may be altered, amalgamated or divided at the discretion of the race committee. Specifically, all boats of a particular design shall race in the same class at the direction of the Race Committee.
3.8 The Race Committee may change the above eligibility factors based on its analysis of the entries received. The Race Committee reserves the right to allocate a boat or boats to a class or division according to the entries received.
3.9 Application for entry shall be made on the official Entry Form and may be made on-line by completing the details required at www.kingscup.com
4. RATING
4.1 The IRC 2009 Rule parts 1,2 and 3 will apply to all Monohull Classes except the Sportsboat and Classic.
4.2 The current RORC/RYA SPORTSBOAT Rule will apply to Sportsboats.
4.3 The current QCYC OMR Rule will apply to Multihulls.
4.4 Boats in the Cruising Multihull class, or, if the Multihull Class is not split as provided in Clause 2, non certified boats in the Multihull class, will be allocated a TCF by the Race Committee based on the current OMR principals. The TCF may be adjusted during the course of the regatta. Calculation and adjustment of TCFs is not grounds for redress or protest.
4.5 Boats in the Classic Class will be allocated a TCF by the Race Committee. The TCF may be adjusted during the course of the regatta. Calculation and adjustment of TCFs is not grounds for redress or protest.
IRC, SBR and OMR Certificates: Competitors wishing to enter a class which requires a current valid IRC, OMR or SBR certificate, shall provide a copy of their certificate with the entry form. Those competitors entering via the website, shall forward a copy of their certificate to the Regatta Office prior to 29th November 2009. Competitors are responsible for obtaining copies of certificates from the relevant issuing authority.
The original or a certified true copy of any required Rating Certificate shall be presented for inspection at the Regatta office no later than 12 hours prior to the Warning Signal of the first race.
An official IRC measurer will be present during the event to check new sails and modifications and may, at his discretion, require any boat in any class/division to be inspected. Any boat requiring measurement shall notify the Regatta office by 12 noon on 28th November 2009 (Saturday). All charges and fees incurred by a boat in obtaining or modifying Rating Certificates shall be borne by the boat owner.
5. CREW LIMITATIONS
5.1 For Racing Class (Using ENDORSED certificates) there shall be no restrictions on crew numbers during the Regatta. IRC Rules 27.4.2 and 27.4.3 shall not apply.
5.2 For all other Classes, there shall be no restrictions on crew numbers during the regatta with the exceptions as detailed below:
5.2.1 A boat sailing as a one-design or racing with a one-design rating certificate shall comply with her class crew limitations unless these have been modified for this regatta.
5.2.2 In the Multihull class, the race committee must be notified of the declared crew weight at time of registration. No alteration to the boats’ TCC will be permitted during the regatta except as a result of a rating protest, or to correct rating office errors,
5.2.2 All entrants are required to submit a completed crew list form to the Regatta Office prior to their first race and to return completed crew change form(s) if thereafter the details of any crew change, prior to any race affected by such change. Copies of the forms will be enclosed with the SI’s and will be available at the Regatta Office and on the official website.
6. SCHEDULE

The reserve day may be used if races are not completed as scheduled or if the Race Committee considers it unlikely that races will be completed as scheduled.
On the last day of the regatta no warning signal will be made after 13.00.
7. COURSES
The courses to be sailed will based on Coastal, Trapezoid, Windward/Leeward, or Triangle formats and will be decided depending on weather conditions.
8. SAILING INSTRUCTIONS
The Sailing Instructions will be available at registration, which is held at Race Headquarters, Kata Beach Resort from 10.00 on Saturday 28 November 2009.
Additional copies of the Sailing Instructions will be available at the Skippers Briefing, which will be held at 16.30 on Sunday 29 November 2009 in the Ballroom at the Kata Beach Resort.
9. PENALTY SYSTEM
For the Multihull, Firefly 850 Sports, Classic and Beach Catamaran classes only, Rules 44.1 and 44.2 are changed so that only one turn, including one tack and one gybe, is required.
10. INTERNATIONAL JURY
10.1 An International Jury, properly constituted in accordance with Appendix N of RRS 2009-2012, will be appointed for the Regatta. There shall be no appeal from the decisions of the international jury in accordance with Rule 70.5.
10.2 The Jury may award a scoring penalty as an alternative to DSQ. The penalty will be at the discretion of the jury. This changes Rule 64.1(a).
10.3 All protests must be submitted in the English Language.
11. SCORING
11.1 The ISAF RRS Appendix A Low Point scoring System will be used. The Regatta is designated as a Series under Rule A2.
11.2 For the Racing class, three races are required to be completed to constitute a series.
(a) When fewer than 6 races have been completed, a boat’s series score will be the total of her race scores
(b) When 6 or more races have been completed, a boat’s series score will be the total of her race scores excluding her worst score.
11.3 For the IRC 1, IRC 2, Sportsboat, Racing Multihull and Firefly 850 Sport classes three races are required to be completed to constitute a series.
(a) When fewer than 5 races have been completed, a boat’s series score will be the total of her race scores
(b) When 5 or more races have been completed, a boat’s series score will be the total of her race scores excluding her worst score.
11.4 For the Premier, Bareboat Charter, Classic, Modern Classic, Cruising and Cruising Multihull classes two races are required to be completed to constitute a series.
(a) When fewer than 4 races have been completed, a boat’s series score will be the total of her race scores
(b) When 4 or more races have been completed, a boat’s series score will be the total of her race scores excluding her worst score.
12. CLASS TROPHIES AND PRIZES
A King’s Cup replica trophy will be awarded to the winning boat in each class. Second and third place prizes will also be awarded in each class.
Other prizes including prizes for individual races, divisional results, overall team performance and line honours may be awarded at the discretion of the Organising Committee.
THE SIR THOMAS LIPTON TROPHY
For the purposes of the Trophy awarded for the aggregated results of the Singapore Straits, Raja Muda and King’s Cup Regattas, all boats in Racing, the IRC Classes and their associated divisions will be eligible.
13. ENTRY FEES
The entry fee of 17,600 Baht must accompany the Entry Form.
Entries must be received by 1 November 2009. For late entries after 1 November 2009, the entry fee is 25,000 Baht.
The entry fee includes participation of skipper. An additional Crew fee of 4,000 THAI BAHT is payable at or before registration for each additional crew member and supporter participating in official functions and parties of the Regatta.
Any boat found racing with unregistered crew members or crew who have not paid the required crew fee prior to racing shall be subject to protest.
In the event of a race being abandoned or cancelled, entry fees will not be refunded.
If written cancellation of entry is received at the King’s Cup Regatta office before 1700 on Friday 20 November, 2009. The whole fee less a 4,000 Baht administration charge will be refunded. After this deadline refunds will be made only in exceptional circumstances.
Crew fees include transport to and from social events, all the official social events and the issue of complimentary Regatta souvenirs. Non-sailing participants may enjoy the social events upon payment of 1000 THAI BAHT per person per night.
14. REGISTRATION
Owners wishing to enter their boats for the Phuket King’s Cup Regatta 2009, may enter online at www.kingscup.com at any time before 28th November 2009, compleating the Entry Form and making payment either online or by bank transfer. Banking details are shown on the entry form page of the website.
15. INSURANCE
Boats are required to be adequately covered by appropriate third party liability insurance to at least the minimum amount of US$ 1,000,000 or THAI BAHT equivalent, and entrants shall declare that such cover is and will be maintained in full force throughout the Phuket King’s Cup Regatta. Also it is recommended that all crew and others on board are adequately insured, including against medical costs.
PLEASE NOTE THAT THIS INSURANCE COVER SHOULD BE MADE PRIOR TO THE REGATTA. ADDITIONAL COVERAGE MAY NOT BE AVAILABLE AT TIME OF REGISTRATION.
16. IDENTIFICATION
All competing boats will be issued with a pair of hull stickers incorporating the Phuket King’s Cup Regatta and sponsor logos and/or an identification number. The decals are to be secured to each side of the fore part of the hull for the duration of the Regatta.
All boats shall carry sail numbers in accordance with RRS Rule 77 and Appendix G. The Race Committee may relieve a boat of her obligations under this Clause, but only if a request is made to the Race Committee no later than 24 hours prior to the warning signal of the first race in which relief is sought.
17. SECURITY
Whilst the Regatta Organisers will do their best to arrange a safe environment for competing boats and crews, all entrants are cautioned to secure valuables at all times during the Regatta. Skippers are required to sign a Declaration upon registration, absolving the Phuket King’s Cup Regatta Organisers of liability in the event of loss. Access to official social functions will be restricted to those who have paid the crew fee or social fee, and are identified by a security tag issued by the Phuket King’s Cup Regatta organisers.
18. DISCLAIMER
Prior to the boat’s first race, the person in charge of each boat and/or his authorize representative shall sign a disclaimer of liability and declaration that they will comply with the RRS. If the person in charge will be under 18 years old on 30 November 2009, then the disclaimer shall be countersigned by a parent or guardian.
A boat is entirely responsible for her own safety, whether afloat or ashore, and nothing, whether in the Notice of Race or Sailing Instructions or anywhere else, reduces this responsibility. It is for the boat to decide whether she is fit to sail in the conditions in which she will find herself. By launching or going to sea, the boat confirms that she is fit for these conditions and her crew is competent to sail and compete in them.
The boat is responsible to ensure that she is equipped and seaworthy so as to be able to face extremes of weather; that there is a crew sufficient in number, experience and fitness to withstand such weather; that the safety equipment is properly maintained, stowed and in date and that the crew knows how to use it; and that the boat and all aboard are adequately covered by appropriate insurance.
Nothing done by the organisers can reduce the responsibility of the boat nor will it make the organisers responsible for any loss, damage, death or personal injury, however it might have occurred, as a result of the boat taking part in the racing. The organisers encompass everyone helping to run the race and the event, and include the Organising Committee, the Race Committee, the race officers, race management personnel and boats, beachmasters and sponsors, and their respective employees and representatives.
